The principal institutions of the Constitution, established in Tasmania after settlement in 1803-04, are considered. The origins of these institutions, particularly their history in English law and in the ot her colonies of the Empire, are taken into account from the experience of the colonies in America before the War of Independence, the colonies in North America (Canada) and those of the West Indies. The development of Tasmania is placed in the context of British colonial policy, principally that of the late Empire, 1783-1870. The legal basis for the establishment of plantations and colonies throughout the Empire is canvassed as background to the legal basis of the settlement of Australia.
