Summary of recommendations: 1. The primary principle for the entry of key business personnel be that it is of benefit to Australia -- 2. The rules for business temporary entrants be simplified by replacing existing range of temporary residence and business visitor classes and subclasses with one class for all business temporary entrants -- 3. The criteria for short-term entry for what are currently business visitors and short-term temporary residents be combined into one set of criteria within the proposed new class -- 4. Streamlined processing be available for long-term entry (more than 3 months and up to 4 years) for companies operating in Australia, including fast track processing where the nominee will be involved in a 'key activity', and standard and pre-qualified sponsorships subject to appropriate undertakings -- 5. Separate and streamlined entry mechanisms for companies not operating in Australia be introduced --
6. The rules for the entry of independent executives be amended to remove ambiguities and align them more closely with the 'established business in Australia' residence sub-class requirements and that the Department of Immigration and Ethnic Affairs develop better and clearer guidelines for the administration of independent executives -- 7. Labour agreements continue to be an option in the appropriate circimstances, but that processes be reviewed and streamlined in cooperation with the Department of Employment, Education and Training, the Department of Industrial Relations and the ACTU; and consideration be given to the term labour agreement being replaced by a more appropriate nomenclature such as 'company/industry employment and training agreements' -- 8. The regional headquarters entry mechanisms be brought within the oepration of the proposed new single business temprary entry visa class --
9. That individual case management be made the responsibility of one case officer, irrespective of where elements of the processing take place -- 10. All sponsors be given the right of review at the time of refusal of their sponsorship and nomination, and that all applicants for the long-term entry (more than 3 months) have access to review rights -- 11. The new arrangements for a single business temporary entry visa class recommended by the Committee be adopted for the grant of new visas for extension of stay in Australia -- 12. Current policy, which allows temporary business entrants to apply to become permanent residents, be continued -- 13. Streamlined health assessment procedures be introduced for all business temporary entrants -- 14. All holders of the proposed single business temporary entry visa, who no longer have access to Medicare, who themselves, or whose employees, have undertaken responsibility for health and medical costs,
be exempt from paying the Medicare levy -- 15. Employers be exempt from the requirement to pay the Superannuation Guarantee Charge in respect of all holders of theproposed single business temporary entry visa; and all holders of the proposed single business temporary entry visa be exempt from the 'employer superannuation contribution' -- 16. A comprehensive monitoring system be established to provide data on individual employers and their nominees, labour market trends, industries and occupations. Consideration be given to the most appropriate use of sanctions when breaches occur. Monitoring will also ensure that streamlined entry is not abused for criminal activities or for circumvention of Government entry policies -- 17. The Committee be given the opportunity to monitor the development and implementation of its recommendations --
18. The Department of Immigration and Ethic Affairs: (i) implement the new entry arrangements and a monitoring system in July 1996; (ii) immediately redraft existing guidelines, within the parameters of existing regulations, to reflect the new principle of benefit to Australia; (iii) establish review, research and consultative processes to ensure that the arrangements continue to meet government policy objectives and business needs; (iv) continue to develop an integrated approach to all business related immigration programs and ensure that this is coordinated with other Government policies; (v) develop a coordinated marketing approach to promote awareness of and information about all business entry options, focussing on the positive thrust of the new arrangements;
(vi) investigate a fair and effective fee structure that will enable the department to deliver a quality services; and (vii) set in place organisational and training programs to maximise the benefits to business of the new arrangements.Æ̧.
