The Australian Telecommunications Authority has responsibility under Part 21 of the Telecommunications Act 1977 for the technical regulation of customer equipment and customer cabling (referred to as 'items' throughout this booklet). To satisfy this, ACA has introduced industry self-regulatory arrangements based on compliance with applicable standards and labelling. The arrangements are given effect by way of the Telecommunications Labelling (Customer Equipment and Customer Cabling) Notice (the Labelling Notice). The compliance arrangements aim to ensure that items meet minimum mandatory standards and are appropriately labelled prior to connection to a telecommunications network. The standards address the personal health and safety of users and operators of telecommunications networks; the integrity of the telecommuncations networks; interoperability with telecommunications networks for the supply of a standard telephone service; and access to emergency call services. Schedule 1 of the Labelling Notice identifies applicable standards and the extent of compliance proof required (the compliance level) for specific items. The compliance level in a given instance, relates to the risk associated with an item being non-compliant with an applicable standard. Australian manufacturers and importers, or their authorised agents, commonly and collectively referred to as suppliers) of specified items, must label the item with either a telecommunications compliance or non-compliance label. Items not specified in the Labelling Notice must not be labelled with either a telecommunications compliance or non-compliance label. For compliant items, the supplier must make a declaration that the item complies with the applicable standard(s). They must also apply a compliance label to the item and hold records supporting claims of compliance. These compliance records are often referred to as compliance folders. Items covered by Schedule 1 of the Labelling Notice, but which do not comply with applicable standards, must be labelled with the non-compliance record.
