The text of a Congressional hearing exploring whether there is validity to complaints that the Equal Employment Opportunity Commission (EEOC) is not adequately and effectively enforcing the protections of the Age Discrimination in Employment Act is presented in this document. The document begins with the opening statement of committee chairman Edward R. Roybal who discusses management problems at the EEOC as well as problems with enforcement, followed by Representative Claudine Schneider's statement. Prepared statements of Representatives Matthew J. Rinaldo, Don Bonker, Tommy F. Robinson, James McClure Clarke, Thomas J. Tauke, and Helen Delich Bentley are presented. Testimony of three panels of witnesses follow. The first panel consists of Charles E. McKeag II, former eexcutive of Goodyear Tire and Rubber Company who describes a complaint he filed with the EEOC; Thomas J. Saltonstall, former director of the Boston area office of the EEOC who reviews Mr. McKeag's case and describes errors made by the EEOC representatives; and Helen Smolin, a former employee of the European American Bank who describes her forced retirement experience and her private lawsuit with the assistance of her attorney, Allen Lerner. The second panel consists of Burton D. Fretz, executive director of the National Senior Citizens Law Center who discusses his opinions about age discrimination; and Judith N. Brown, National Treasurer and member of the Board of Directors, American Association of Retired Persons, accompanied by Christopher G. MacKaronis and Michele Pollak, who focus on early retirement incentives and the EEOC's regulations interpreting pension accrual requirements of the Omnibus Reconciliation Act. The final panel consists of Clarence Thomas, Chairman of the EEOC, accompanied by Charles Shanor, General Counsel of the EEOC, who presents his appraisal of the EEOC's actions and what has been done to rectify the problem.
