- Summary:
-
In April 2019, Tasmania introduced new laws surrounding assigning gender on birth registration, changing registered name or gender, gender re-assignment surgery prior to application, and related issues affecting transgender and intersex people. This paper launches a review on two areas in particular: the legal recognition of sex and gender and consent to medical treatment to alter a person's sex or gender. It discusses the issues and invites feedback from the public. Particular concerns raised include the implications for gender-specific organisations, police search powers and historical investigations, the rigour of demographic datasets, and consent to medical treatment for intersex and transgender minors. A list of state and national laws relating to sex and gender and cases relating to medical procedures for minors are included in the appendix.
