The Attorney-General called for this inquiry to investigate the over-representation of Aboriginal and Torres Strait Islander adults in prison and develop recommendations for how laws and legal frameworks could be reformed to address this issue. Although Aboriginal and Torres Strait Islander adults make up around 2% of the national population, they constitute 27% of the national prison population. While it is difficult to disentangle historical, social and economic disadvantage from legal issues that contribute to the incarceration of Aboriginal and Torres Strait Islander peoples, the inquiry focuses principally on criminal laws and legal frameworks. This inquiry considers the role of laws, courts, police, and access to legal assistance, mandatory sentencing, diversion programs, fines and drivers licences, the incarceration of women, alcohol and offending, pathways through the criminal justice system, alternatives to custody, and the crossover from out of home care into detention.
